Key Real Estate Photography Resolves Federal Court Copyright Proceeding

PERTH, WA — In September 2025, Key Real Estate Photography commenced proceedings in the Federal Court of Australia against a Perth real estate agency and its Principal. The proceedings concerned allegations of copyright infringement in respect of their use of photographs taken by David Williamson for sale and lease listings beyond the original authorised use.

Following mediation in March 2026, the parties reached a settlement and the proceeding was resolved. As part of the resolution, the defendants provided an undertaking to the Court that they would not use the photographs that were the subject of the proceeding or have them available on their website.

While the terms of settlement are confidential, Key Real Estate Photography is pleased with the outcome, which included a five-figure settlement. The matter involved alleged unauthorised use across multiple listings and platforms and required formal Federal Court proceedings to resolve.

This outcome highlights that reuse of photographs beyond their original authorised purpose can expose real estate agencies to court proceedings, significant financial consequences, and enforceable restrictions on future use.
